Terms & Conditions

1. Scope of application
These General Terms and Conditions (T&C) shall apply to the order and the delivery of goods which the customer orders with soomz ag online on the internet at soomz.io.
2. Exclusive applicability of these T&C
The present provisions shall exclusively apply in the framework of the scope of performance.
3. Contract conclusion
The contract between the customer and Soomz AG (Soomz) is concluded by the customer's order and the relevant acceptance by Soomz. Orders are placed as purchase orders by filling in and submitting the Soomz online order form. Soomz shall accept the order by delivering or partially delivering the ordered goods. All offers by Soomz shall be non-binding.
4. Availability and delivery
Deliveries shall occur directly from our warehouse. Delivery times and dates which soomz ag indicates can be delayed by customs clearance or third-party service providers that are not under control of Soomz. For logistical reasons, orders of several articles may be divided into several partial deliveries.
5. Right of retention
Delivered goods shall remain in the property of Soomz until the purchase price was paid in full.
6. Costs of delivery
If nothing deviating was agreed, costs of delivery shall be included in the purchase price.
7. Conditions of payment
The purchase price must be paid upon order. The customer may choose between vaious payment options.
8. Right to cancel
Soomz grants the customer the right to cancel the contract within 14 days from the day on which the customer acquires, or a third party other than the carrier and indicated by the customer acquires, physical possession of the last good. To meet the cancellation deadline, it is sufficient for the customer to communicate the cancellation to Soomz (Soomz AG, Althardstrasse 70, CH-8105 Regensdorf, firstname.lastname@example.org, +41 44 240 55 77, soomz.io/getintouch) by a clear statement through the contact form, via e-mail, phone or letter before the cancellation period has expired. The customer shall send back the goods or hand them over to Soomz within 14 days from the day on which the customer communicates his withdrawal from the contract. The customer will have to bear the direct cost of returning the goods. Soomz may withhold reimbursement until reception of the returned goods or the customer has supplied evidence of having sent back the goods.
9. Data protection regulations
The processing of the customer's personal data occurs exclusively in compliance with legal provisions. The customer consents to the post communicating his correct address if goods can not be delivered to the address given by the customer.
Should one or several provisions contained in these General Terms and Conditions be invalid, this shall not affect the validity of the remaining contract. Invalid provisions are substituted by legally valid provisions.
11. Final provisions
Place of jurisdiction and performance shall be Zurich, Switzerland. This contract shall be governed by Swiss law; the United Nations Convention on Contracts for the International Sale of Goods (CISG) shall be completely excluded.
